Terms and conditions
of CXMXO UG (haftungsbeschränkt), Hansaring 1, 50670 Cologne, Germany (hereinafter "YachtRental.one")
§ 1 Subject matter and role as intermediary
YachtRental.one operates an information and brokerage platform for yacht charter. YachtRental.one acts exclusively as an intermediary (lead generator) and is not a travel organiser. Submitting an inquiry does not create a contract between the user and YachtRental.one. The charter contract is concluded exclusively between the user and the respective operator (charter provider); offer, contract, options and payment are handled directly with the operator. YachtRental.one does not accept payments for charters and does not create bookings or options.
§ 2 Inquiry process
The user can submit a non-binding inquiry using the form. YachtRental.one forwards it to one or more suitable operators from its partner network. There is no entitlement to forwarding or to an offer.
§ 3 Prices
All prices shown are non-binding estimates based on historical market data and do not constitute a binding offer. Only the individual offer of the operator is decisive. As a rule the base price does not include: APA (advance provisioning allowance for fuel, harbour fees, provisions), final cleaning, skipper (unless included) and tourist tax.
§ 4 Exclusion of liability
YachtRental.one is not liable for the services, availability or safety standards of the operator. YachtRental.one gives no guarantee for the accuracy, completeness or timeliness of the information shown, in particular prices and yacht data. Liability for slight negligence is excluded to the extent permitted by law, except for breach of essential contractual obligations, damage to life, body or health, or claims under the Product Liability Act.
§ 5 Disclosure of data
By submitting the inquiry the user agrees that the data provided will be forwarded to an operator for the purpose of obtaining an offer. Further details are set out in the privacy policy.
§ 6 Obligations of the user
The user is obliged to provide truthful information. For bareboat charters the required boating licence (e.g. ICC, SKS, SBF See) must be presented at handover at the latest. Use of this website for automated inquiries or abusive purposes is prohibited.
§ 7 Cancellation
Cancellation terms are governed by the binding offer of the operator. Typical industry guide values:
| Period before charter start | Cancellation costs (guide value) |
|---|---|
| More than 60 days | approx. 25% of the charter price |
| 30–60 days | approx. 50% of the charter price |
| Less than 30 days | up to 100% of the charter price |
Only the cancellation terms of the respective operator are binding.
§ 8 Dispute resolution and jurisdiction
Consumers can use the German universal arbitration board (Zentrum für Schlichtung e. V., Straßburger Straße 8, 77694 Kehl, Germany). YachtRental.one is willing to participate. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for merchants and legal entities under public law is Cologne.
§ 9 Changes to these terms
YachtRental.one reserves the right to change these terms at any time. The current version is available on this website.
